The present work aims to shed light on the parameters that make Religious Law an autonomous branch of Law. Through bibliographic, descriptive, and investiga-tive research of the Brazilian Legal System, the importance dispensed to religiosity and belief by the Brazilian Constitution and by infraconstitutional legislation is demonstrat-ed and so is the consequent autonomy of the area of law that regulates the relationships of the faithful and the church in society, especially in guaranteeing their rights.
